Ripple vs. SEC: Key Developments in the Remedies Stage

Significant progress has been made in the remedies phase of the ongoing legal battle between Ripple and the US Securities and Exchange Commission (SEC). The SEC has filed its remedies reply brief under seal, a pivotal step in determining potential sanctions against Ripple if the SEC proves its allegations.

The SEC’s filing, submitted under seal, marks a crucial procedural advancement in the litigation. James K. Filan, a former defense lawyer closely monitoring the case, informed the XRP community that the documents are currently not public but that he will make redacted versions available by May 8, 2024. 

After the sealed filing, Ripple and the SEC will discuss redactions on May 7 to decide what stays confidential and what gets disclosed. The SEC will release a redacted version of the reply brief and supporting exhibits on May 8. This release will include provisional redactions requested during the May 7 meet and confer.

On May 13, all parties will file motions to seal materials related to the remedies briefing, followed by proposed redactions.

Legal expert Jeremy Hogan predicts the SEC will likely win, expecting the court to recognize Fox as an expert, allowing Ripple to depose her instead of striking her testimony.
